Zakat on investments and shares

Question

Assalamu alaikum
1)I have invested some amount on a company since 2019 on profit share basis . I have not received any profit in my hand till now even though profit is reflecting in accounting. Should i have to pay zakat on the accounted profit or on the principal amount invested?
2) I have another investment which was done in Islamic shares which gives a profit based on loss/gain of the investing areas. This also since 2019 and showing profit on paper and I have not received a single penny from it. There is also a locking period of 5 years for this fund to redeem the profit or capital amount. So how should I give Zakat for this?

There is some ambiguity in the question about the nature of your investments.

In my understanding, the first investment was made in a private company – not as shares in a publicly-traded company. That is to say, one invested in a business and was expecting to be remunerated based on a profit-share basis or dividends. In such a circumstance, one is a partner in a business. Zakat is necessary on cash, inventory, and receivables of the company, based on the percentage they own.[1] Thus, if one is a 33.3% owner of the business, they are obligated to account for 33.3% of the cash, inventory and receivables of the business in their zakat calculations. If I have misunderstood the investment, please write back to us.

As for the second type of investment, you have stated that there is a lock-in period of five years before one is able to redeem the profit or capital. This would amount to a strong receivable loan (dayn qawi). This means that zakat is necessary on this amount year on year, however one is only obligated to dispense the zakat once they possess the wealth.[2] For example: on the zakat anniversary of year one, the investment is worth £1000. This means that one is obligated to pay £25 of zakat, though only when the money is received. In year two, the investment is worth £1500 which would render zakat £37.50 for that year. Once the money is received, one is obligated to backdate the zakat for all the years missed. In this two year example, one would backdate £62.50 as missed zakats.

For ease, it is recommended that you account for the second investment in your zakat calculations and dispense it every year.

المحيط البرهاني في الفقه النعماني (7/ 131)  قال محمد رحمه الله في «الجامع» : رجل استقرض من رجل كراً من طعام، ثم إن المستقرض اشترى من المقرض الكر الذي عليه بمائة درهم جاز الشراء؛ لأن المستقرض صار ملكاً للمستقرض بنفس القبض، ووجب عليه للمقرض كراً مثله، فصح الشراء، بخلاف ما إذا اشترى غير من عليه الدين حيث لا يجوز؛ لأنه لا يمكنه التسليم إلا بالقبض، فكان عاجزاً عن التسليم للحال فلا يجوز، أما ههنا المبيع في يد المشتري؛ لأنه في ذمته وذمته تكون في يده أيضاً، فلما اشترى وقع مسلماً إليه فصح. وإذا جاز الشراء إن نقد المائة في المجلس، فالشراء ماض على صحته، وإن لم ينقدها في المجلس بطل لافتراقهما عن دين، وهذا بخلاف ما إذا وجب على المستقرض كر حنطة، ثم إن كل واحد منهما باع ماله على صاحبه بما لصاحبه عليه حيث يجوز، وإن افترقا عن المجلس من غير قبض شيء لأن هناك الافتراق حصل بعد قبض البدلين حكماً؛ لأن بنفس الشراء ملك كل واحد ما ذمته إذ ذمته في يده، قالوا: وهذا على قول أبي حنيفة ومحمد رحمه الله؛ لأن عندهما المستقرِض يصير ملكاً للمستقرض بنفس القبض، فيجب عليه مثله ديناً في الذمة فيصح الشراء. أما عند أبي يوسف: فالمستقرض لا يصير ملكاً للمستقرض إلا بالقبض مع الاستهلاك، فلم يجب في ذمة المستقرض شيء، فلا يصح الشراء، فإذا استهلكه ثم اشتراه لا يصح بلا خلاف، وكذلك الاختلاف في الملك في المنقود وسائر ما يستقرض. وجه قول أبي يوسف رحمه الله: أن (القبض) بمنزلة العارية، ولهذا لا يصح التأجيل فيه مع صحة القرض وجعلت إعارة كل مكيل وموزون قرضاً، لا إعارة تمليك المنفعة، ولهذا لا يملكه المكاتب والعبد والأب والوصي، والإعارة تمليك المنفعة لا تمليك العين إلا أن منافع هذه الأعيان لا تنفصل عن الأعيان، فأقيمت المنافع مقام الأعيان، ثم المنافع لما كانت لا تملك إلا بالاستهلاك، فكذلك الأعيان التي قامت مقام المنافع.
