Umrah in the months of hajj

Question

Asslamualaykum Warahmatullahi Wabarakatuhu,

I am planning on going for Umrah after Ramadan around end of May/Beginning of June time for about 7-9 days.

Someone said to me,if i go for Umrah in between the time period of the months of Ramadhan and Hajj, then Hajj becomes compulsory on me.

Is this statement true as I’ve never heard of it before.

I haven’t completed my 1st Hajj yet, as I am
Still saving up for it, however I have a firm intention to go within the next 1-2 years Inshallah.

Answer

In order for Hajj to become obligatory upon a person certain conditions must be fulfilled. For example, if someone lives outside the miqat boundary, they must be able to afford the cost of travel and also other related costs such as food and accommodation. If a person is already in Makkah during the months of hajj, which start from shawwal, then the condition of being able to afford the cost of travel is no longer applicable in certain scenarios, as the individual is already present. This is what is meant by hajj being obligatory on a person who is in Makkah during the months of hajj. This is because they are able to afford the cost of staying there and are able to carrying out their hajj. Hence, the conditions of hajj being obligatory are fulfilled for that person.

On the other hand however, if someone is in Makkah during the months of hajj, but they cannot stay due to the cost of accommodation or visa issues, then hajj will not become compulsory upon them. The reason for this is that even though the cost of travel may not be a requirement for them, but the cost of accommodation and other related costs still are. Therefore, if they are unable to stay until hajj then it will not be compulsory upon them.

والحاصل: أن الزاد لا بد منه ولو لمكي كما صرح به غير واحد كصاحب الينابيع والسراج، وما في الخانية والنهاية من أن المكي يلزمه الحج ولو فقيرا لا زاد له نظر فيه ابن الهمام إلا أن يراد ما إذا كان يمكنه الاكتساب في الطريق، وأما الراحلة فشرط للآفاقي دون المكي القادر على المشي وقيل شرط مطلقا لأن ما بين مكة وعرفات أربع فراسخ، ولا يقدر كل أحد على مشيها كما في المحيط وصحح صاحب اللباب في منسكه الكبير الأول، ونظر فيه شارحه القاري بأن القادر نادر ومبنى الأحكام على الغالب، وحد المكي عندنا من كان داخل المواقيت إلى الحرم كما ذكره الكرماني، وهو بعيد جدا بل الظاهر ما في السراج وغيره أنه من بينه وبين مكة أقل من ثلاثة أيام وفي البحر الزاخر واشتراط الراحلة في حق من بينه وبين مكة ثلاثة أيام فصاعدا أما ما دونه فلا إذا كان قادرا على المشي وتمامه في شرح اللباب
