Irrevocable Divorce

Question

As Salamu Alaykum,

About 6 months ago during argument an “Talaq-kinaya (ambiguous talaq)” was said several times with the intention of talaq. So one talaq ba’in took effect and no new nikah contract was made. The husband was unaware of the effect of the first talaq kinaya and the marriage was continued without making a new nikah.
6 months later a Talaq-sarih was said 3 times in a row With the words “I divorce you, i divorce you , i divorce you“ Is it possible to make a new nikah because the clear talaq (which was pronounced 3 times) is not valid because the marriage was irrevocable divorced 6 months ago?


Answer

If several divorces are given one after the other each with ambiguous (kinayah) words, only the first of those counts and the rest are void.

After the husband utters a divorce with ambiguous words the nikah is immediately broken and the woman no longer remains his wife, and there is no opportunity for revocation of the divorce during the waiting period. Therefore, if the man gave the woman further divorces with clear or ambiguous words six months later, they would not count as she is no longer his wife and divorce given to a woman other than a wife are void.

The couple may enter into a new nikah or separate immediately and must seek forgiveness from Allah for having lived together in sin for the last six months.

والبائن لا يلحق البائن إلا أن يتقدم سببه بأن قال لها: إن دخلت الدار، فأنت بائن ونوى بها الطلاق ثم أبانها ثم دخلت الدار وهي في العدة وقعت عليها تطليقة بالشرط عند علمائنا الثلاثة رحمهم الله خلافاً لزفر رحمه الله.
