Question

My wife’s sister breastfed my two daughters, and my wife breastfed her sons to establish a mahram relationship between them. This reciprocal breastfeeding arrangement continued for approximately a year and a half. I understand that they are now considered mahram to each other, and I am also considered mahram to her children, and vice versa. However, my wife’s sister has recently remarried, and I am curious to know if her new husband also holds the status of mahram to my daughters?

Answer

There are various ways in which a person can become a mahram. In your specific case the new husband will not be considered the milk father. However, he will still become a mahram to your daughters once he consummates marriage with your sister-in-law, as he will then be the husband of their mother.

البحر الرائق شرح كنز الدقائق ومنحة الخالق وتكملة الطوري (3/ 242) – قَوْلُهُ: (زَوْجُ مُرْضِعَةٍ لَبَنُهَا مِنْهُ أَبٌ لِلرَّضِيعِ وَابْنُهُ أَخٌ وَبِنْتُهُ أُخْتٌ وَأَخُوهُ عَمٌّ وَأُخْتُهُ عَمَّةٌ) بَيَانٌ لِأَنَّ لَبَنَ الْفَحْلِ يَتَعَلَّقُ بِهِ التَّحْرِيمُ لِعُمُومِ الْحَدِيثِ الْمَشْهُورِ وَإِذَا ثَبَتَ كَوْنُهُ أَبًا لَهُ لَا يَحِلُّ لِكُلٍّ مِنْهُمَا مَوْطُوءَةُ الْآخَرِ، وَالْمُرَادُ بِهِ اللَّبَنُ الَّذِي نَزَلَ مِنْ الْمَرْأَةِ بِسَبَبِ وِلَادَتِهَا مِنْ رَجُلٍ زَوْجٍ أَوْ سَيِّدٍ فَلَيْسَ الزَّوْجُ قَيْدًا فِي كَلَامِهِ.

قَيَّدَ بِقَوْلِهِ لَبَنُهَا مِنْهُ لِأَنَّ لَبَنَهَا لَوْ كَانَ مِنْ غَيْرِهِ بِأَنْ تَزَوَّجَتْ بِرَجُلٍ وَهِيَ ذَاتُ لَبَنٍ لِآخَرَ قَبْلَهُ فَأَرْضَعَتْ صَبِيَّةً فَإِنَّهَا رَبِيبَةٌ لِلثَّانِي بِنْتٌ لِلْأَوَّلِ.
