Inheritance distribution

Question

Asalam
My grandfather have 11 children. My grandfather passed away in 2013. He did not shares his property equally among his sons. My father did not get anything. some property have not yet share. Should they share the remaining property among them or they should give my father share and then share the remaining property.


Answer

It is the right of each lawful heir to receive his share of inheritance from the estate of the deceased as allocated in the Qur’an. At the time of your grandfather’s demise, your father was entitled to his share. If he did not receive this amount, it will be a debt on those who have unlawfully acquired it to repay. Hence, the priority should be to pay your father his full share (and any other heir who has not received their share) from whatever remains of your grandfather’s estate.

{ يُوصِيكُمُ اللَّهُ فِي أَوْلَادِكُمْ لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِ} [النساء: 11]

سنن أبي داود (3/ 114) حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ نَجْدَةَ، حَدَّثَنَا ابْنُ عَيَّاشٍ، عَنْ شُرَحْبِيلَ بْنِ مُسْلِمٍ، سَمِعْتُ أَبَا أُمَامَةَ، سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّ اللَّهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ فَلَا وَصِيَّةَ لِوَارِثٍ»

مرقاة المفاتيح شرح مشكاة المصابيح (5/ 2038) (وَعَنْ أَبِي أُمَامَةَ قَالَ: «سَمِعْتُ رَسُولَ اللَّهِ – صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ – يَقُولُ فِي خُطْبَتِهِ عَامَ حِجَّةِ الْوَدَاعِ» ) بِفَتْحِ الْوَاوِ وَيُكْسَرُ ( «إِنَّ اللَّهَ قَدْ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ» ) أَيْ: بَيَّنَ لَهُ حَظَّهُ وَنَصِيبَهُ الَّذِي فُرِضَ لَهُ
