Surrogacy

Question

Assalamualiakum wr wb,
We are a muslim couple married for 16 years, Alhamdulillah. We don’t have a child even after going through so many treatments. As of now my husband wants to go for surrogacy but i am not at all ready for it.
He says that he has made up his mind for it and wants to go for it and that i wont get involved in this surrogacy technically but will have to rear up the child .
Under such scenario, is it permissible for me to rear up such child. Furthermore , is this a ground to move out from such marriage contact.
What should be my stand on this? He is not ready for adoption.


Answer

Surrogacy is not permissible in Islam. Inserting seminal fluids of a man and/or woman into a third person is similar to zina and thus unlawful. The third person who carries the child will be established as the child’s mother as they gave birth to them and not the female donor. The male donor will also not be considered the father as the relationship is classed as zina and in zina lineage is not attributed to the biological father. Hence, if your husband takes part in surrogacy even with his own fluids, Islamically this will be unlawful and he will also not be considered the father of the child.

Your marriage places no obligation on you to bring up this child.

If your husband is still going to go ahead with the process regardless then you should explain to him that you are not happy with this. If this is going to create on-going problems in your marriage which you are not able to get through then you would be within your rights to request a divorce from him. However, this should be the last resort after attempting other methods of reconciliation.
